Dorky "takedown" notices

Postby Pattern_Juggled » Mon Dec 02, 2013 9:43 am

Over the years, I've seen a hell of alot of strange "takedown notices" come through my inbox - first when I was involved in the early days of Cryptocloud, and even more so with cryptostorm. In the old days, these were largely sent by actual human beings - still silly, but they had a certain degree of organic substance to them. Nowadays, it's almost all automated: copytroll spambots.

Back in the day, we made a point of replying to all the handmade "takedown notices" that came our way, explaining (patiently... sorta) why we as a network service provider have nothing to "takedown" in the first place. They never replied back - all the heavy-breathing lawyerspeak just fell apart when we actually asked for clarification and statutory citation.

But with the automated trollbots, replying is sort of a waste of time. From time to time, we'll send a reply off pointing out that - in many jurisdictions - spam is itself illegal to distribute. We never get replies.

So for the sake of enjoyment, I figured that from time to time we'd copy a few of them out here for public perusal. Some are so weird as to be almost works of art. Almost. Most are just dumb. Note that many of these related to the tracker proxies we host as public services... so they're sending "takedown" notices to a proxy provider who in turn is just passing traffic to a tracker, which is itself not hosting anything but acts functionally as a search engine for content self-hosted by swarm participants. Brilliant.

Here's the first one:

Here's another one - these guys have been generating a pretty high volume of this spam in recent months, no idea what their backstory is but if one does reply to these "warnings," there's no response forthcoming.

...and yea, the consistently-broken formatting on these "demand letters" is always so helpful in judging the relative credibility (or lack thereof) with which they can be attributed:

I love takedown notices but prefer the ones that are written by humans. One of the most funny pages on the internet is the "legal threats" section from The Pirate Bay. I especially laughed about the ones written by "WEB SHERIFF". Seriously! Read that stuff and you'll piss your pants because they are so full of shit and proud about it. The TPB answers are funny aswell. I'm literally laughing while writing this just because I remember reading through that. I won't link directly to that because it's like 10 documents but you can find it on the page I linked.

So please continue posting legal threats here. I hope there will be some very funny ones written by humans in the future.

Mr. Swales -

We are in receipt of your correspondence requesting "expeditious action to remove or disable access to the material described [herein]," relating to an allegation of commission of civil tort under U.S. law.

Thank you so much for taking the time to make us aware of this matter.

To aid in our investigation of the situation, and i furtherance of a deeper understanding of your legally-constituted role in such, we ask that you forward to our attention the forensic reporting on which you base your allegations. We naturally understand that your expertise in such matters runs considerably deeper than ours. Nevertheless, let us suggest that digitally hashed (with a non-reversible/non-rainbowed algorithm, of course) .pcaps of the alleged transfers will be a good starting point. Full server-side logfiles corresponding to these packet-layer captures will be needed to independently validate the legitimacy of the tcpdump output, it goes without saying. Router-layer log data is always helpful - we're sure you concur - so please do send those along, as well. If they're in a nonstandard format, a pointer to relevant documentation of such is much appreciated.

We also ask that you provide us with your preferred independent forensic examiners, so that we may review their credentials and historical experience in documenting such matters. We, needless to say, have several examiners with which we are personally familiar - but it would be unseemly for us to suggest that our own contacts would be of more relevance than those which you will certainly be able to suggest from past working experience.

Once we have completed the necessary work to forensically validate your assertions (as set forth in the quoted correspondence included below), we will be in a much better position to begin the process of responding to the rather novel legal interpretation you suggest. Carts not belonging before their respective horses, let us first work through the forensic issues; obviously, there's no point in arguing legal matters if (in purely hypothetical terms) you lack any sort of independent, forensically sound basis on which to make said allegations.

Finally, as we have not in the past found it productive to engage in "discussions" with automated extortion-bots, we ask that you provide some manner through which we can confirm that these emails from you are coming from, well... from you, and not from a programmatic extortion-bot. Given the provisions of the CAN-SPAM Act, you will understand our concern that honouring an illegal spambot with "replies" would border on dark satire. Rather, we report those programming and profiting from such illegl spambots to the relevant legal authorities for prosecution. Help stop spam, &c.

Thank you again for your deep concern in protecting artists from nefarious intent. It is a refreshing pleasure to find someone who selflessly seeks to ensure that creative people receive full and just reward for their contributions to our shared culture!

Best regards,

USA! USA! USA!

Postby cryptostorm_team » Mon Feb 24, 2014 8:37 pm

With mere hours having elapsed since we brought our U.S. exitnode cluster live, the extortion-bot demand letters are already rolling in. God Bless Amerika!

Hot off the virtual presses, one of our replies:

Mr. Siegel -

We are in receipt of your correspondence requesting that we "immediately and permanently cease and desist from unauthorized copying and/or distribution" of certain claimed works of intellectual property.

Thank you so much for taking the time to make us aware of this matter.

To aid in our investigation of the situation, and in furtherance of a deeper understanding of your legally-constituted role in such, we ask that you forward to our attention the forensic reporting on which you base your allegations.

That we neither "copy" nor "distribute" anything whatsoever is a matter of basic factual reality: we merely route packets, neutrally & without any involvement in either their payload or their header data. As such, we're at a loss to imagine exactly how we could "cease and desist" from doing either of the action-verbs you cite. Irrespective, the question of valid & independently verifiable forensic data comes first.

Rather, we report those individuals programming and profiting from such illegal spambots to the relevant legal authorities for prosecution. Help stop spam, &c.

The rule of law applies to everyone, and nobody is exempt from the provisions of criminal law merely because of how many lobbyists they employ nor how unseemly the intertwining of those lobbyists with the mechanisms of governance in your "Land of the Free," and all that.

Anyhow.

Thank you again for your deep concern in protecting artists from nefarious intent - particularly the notable artistic talent which has produced for the human cultural world's eternal appreciation.... let's see. Ah, yes: Family Comes First. A truly priceless artifact of our shared culture, truly worthy of the strongest forms of intellectual property enforcement.

It warms one's heart - literally, our hearts heat by measurable degrees as we type these very words - to see such selfless dedication to the beloved, cherished core of our social environment: protecting the lone artists from piratical plunder, and so on. In short, it is a refreshing pleasure to find someone who selflessly seeks to ensure that creative people receive full and just reward for their contributions to our shared culture. Bravo! Hoora! Tally-ho!

Best regards,

ps: we had no idea that poor old port 1043 was an "unauthorized port" - would you be so kind as to send along the relevant citation to IETF documentation on that question? It's news to us!

WHAT?? Didn't you know the BOINC client was capable of downloading (what is very obviously) porn? Duh, like everyone knows that already... :p lol Seriously though, talk about a mail-merged email autobot. If they had specified port 10433 then *maybe* it might be considered a genuine request (by somebody, somewhere), but this?

They never respond.

That's the thing that gets me. In years and years of helping to handle the required "takedown notice responses" we get from hosting providers day in and day out... these bots never respond, when you email them with a question. Never.

What a scam.

Would it be (un)reasonable to assume that if you replied "Where can I pay?", they wouldn't respond either? :p

I wouldn't be surprised if the copyrighted material in question is just randomly picked from a database with thousands of titles rather than from an actual record about somebody downloading with the exit nodes IP.
There was a large scam wave years ago in my home country where a law company just randomly sent out letters, demanding damages on claims of copyright infringement. In the end the whole thing blew into their faces when old grannies that still use rotary phones and long dead people turned out to be recipients of lots of those letters and journalists (which back than knew even less about law and technology) finally realized this is a story and made it public. Nonetheless in the meantime they received humongous amounts of money from people who were scared and just wanted to be left alone. I don't remember if they were sued or not but several smaller attempts by other lawyers were made in the following years until judges caught up on technology and nowadays it's no actively used scam anymore afaik.

About the bots being too stupid to answer to replies:
I wonder why that is. The people running them must be totally cheap bastards because technology is very well able to make believable conversation with humans. Telephone marketing companies in the US for example have pretty convincing bots that dynamically answer to questions and other responses. There is still a 1 - 1,5 second delay due to processing of the human input but if they manage to cut that down further these bots become scary realistic.
Voice synthesizing also plays a major role in this because it enables the machine to create new outputs rather than only having prerecorded ones.

Here is a video where a guy does a quasi Turing test on one of those telemarketing machines by asking them to say "I am not a robot" which they can't because this sentence was not prerecorded. People I talked about this video say that especially the use of laughter makes this very convincing because you don't expect a machine to show emotions.

Just found a second video:

Question: Can you keep a presence in this US datacenter (or in general any datacenter but especially in US) without showing them somehow that you've taken some sort of action? What are the chances they will boot you?

...and reply:

Mr. Beck -

We are in receipt of your correspondence requesting that we "stop downloading or uploading any film or TV shows owned or distributed by NBC Universal without authorization; and [p]ermanently delete from your computer(s) all unauthorized copies you may have already made of these movies and TV shows." relating to an allegation of commission of civil tort under U.S. law.

Thank you so much for taking the time to make us aware of this matter.

To aid in our investigation of the situation, and in furtherance of a deeper understanding of your legally-constituted role in such, we ask that you forward to our attention the forensic reporting on which you base your allegations.

~ cryptostorm

Ah, yeah...

Protip: if you're going to bother going through the motions of signing emails with a PGP public key, and you're going to crow about how clever you are that you figured out how to use MIT's public keyserver, at least use a decent keypair in the first place..

ffs...

Check out the date on which this key was issued, too. Must have some amazing opsec, to be confident in using a key - 1024 bits, at that! for over a decade. That, or perhaps the key is simply junk. Probably that, tbh.

Plus, the email above that is so ostentatiously signed by this crap-ass keypair is allegedly from a Mr. "Andrew Beck." But the key isn't listed under that name at MIT, not at all.

Instead it's listed as being controlled by:

Code: Select all

 Aaron Markham <antipiracy@nbcuni.com>

And we can further see that Mr. Markham also has another key with the MIT keyserver, for this email address:

Code: Select all

Ambrose Carracho <ambrose_carracho@hotmail.com>

PGP keys and hotmail address: a tragic combination... plus, he's sure been active with this whole slingin' crypto thing, hasn't he? And not very good opsec: " Administrator <earwigranch@adelphia.net>" <-- Earwig Ranch? That, in turn, leads us to more info on this dude, whoever he really is. D0x much, bro?

That age-old key's a doozy, too...
